PRODUCTIVE CLUBHOUSE ENTERTAINMENT MEETING HELD

Hi all,

The Operations Committee met this afternoon to discuss the upcoming shows and entertainment for the new season.

While no contracts have been signed, it is clear that a fine schedule is in store, with some real surprises on the agenda. Prices will be held stable.

This meeting almost never happened because of the antics of a small dedicated group of disruptive persons that most of you would recognize.

It is the same group of individuals that rise regularly at our Delegate Assembly meetings and have no constructive input, all they bring is disruption, unfounded complaints and baseless criticism. It is the same group that send negative articles to the UCO Reporter with no useful or informative content.

This meeting is a yearly event, and has always been closed to all persons except the Operations Committee members; why is it closed you ask, because proprietary information about each performers contract and compensation are discussed, and these performers have a right to their privacy on such matters.

At the first attempt to hold the meeting earlier in the day, the small group referenced above entered the UCO conference room, ensconced themselves along the wall; and when advised of the proprietary privacy issues involved, refused to leave. This left me no choice but to adjourn the meeting for reschedule at a later time.

UCO simply will not succumb to such threats and disruption, we were elected to do the unit owners business, not to pander to disruptive malcontents.

They want to eliminate all funding for Public Broadcasting

Three amendments have been introduced in the U.S. Senate with the goal of eliminating all funding for public broadcasting.

These amendments to the Small Business Act Reauthorization (S. 493) were filed by Senator Tom Coburn (OK), Senator Jim DeMint (SC) and Senator Rand Paul (KY) in an attempt to put the Senate’s position on public broadcasting on the record.

We cannot allow these amendments to attract support and threaten funding vital to your local public radio and television stations. Votes on these amendments could occur as early as this week.

Please call Sen. Bill Nelson (202) 224-5274 and Sen. Marco Rubio (202) 224-3041 today. When talking with your Senators or leaving a message with their staff, make these points: I understand that S. 493, the Small Business Act Reauthorization, has three amendments filed that would eliminate funding for public broadcasting.

MORE ON "SEND MONEY" SCAM

A 92-year-old mother of a friend was scammed the other day, same old story—one of her kids was in distress and needed money. Two factors made it seem real to the mother.

I asked my friend, "Couldn't your mother tell it wasn't your voice on the phone?" She said, "No, because the caller said she had been in a car accident and sounded very upset and excited, not like her normal self." Then, to clinch it, the caller had an "attending policeman" (an imposter, of course) come on the line and verify what she had said. That made the whole thing sound real to the mother. She was told to wire $3000 by Western Union, and she did.

Fortunately, she then immediately called her daughter's home and learned that she was safe at home and there had been no accident. The mother got down to the Western Union office in time to stop the transaction from going through.

FLORIDA DEREGULATION BILL – Part 2

For a change -- some great News: The new version of H5005 to be approved at today's committee meeting -- as posted on the website of the House Committee on Economic Affairs -- shows that all provisions regarding the removal of license requirements for community association managers (CAMs) and all wording regarding dissolving the Division of Florida Condominiums, Timeshares and Mobile Homes and the Condo Ombudsman's Office have been removed.
Thanks to all the many folks who contacted our legislators in opposition of the bill, who helped our legislators see the light at the end of the tunnel and doing the right thing: Stop these ill-advised parts of this bill that would have been detrimental for millions of people living in Florida's community associations....

Golf's Edge Saga Takes a Bizzare Twist.


The ongoing saga of Golf's Edge took a bizarre twist this week when routine research on Issac Feder’s attorney, Esther Zaretsky, revealed a much closer connection with Century Village here in West Palm Beach.
In 2009 Ms. Zaretsky purchased an apartment in a garden building for her father, a surgeon who had been released on parole after serving more than 30 years for the murder of her mother in Great Neck, Long Island in 1975. ‘The UCO Reporter’ has since discovered that he is now, serving on the board of that Association in clear violation of Florida Statute.
The discovery was made by the president of the United Civic Organization, David Israel, a strong supporter of Golf's Edge and their plight, whilst researching Ms. Zaretsky’s distinguished career as an attorney. Her purchase of the apartment, and it’s subsequent transfer, prompted further investigation to reveal the presence of her father in Century Village, a convicted murderer and the subject of a book and numerous articles written on his crime. Now ailing, he was released on his sixth attempt for parole having been sentenced to life imprisonment. Her father, now 92 years old was charged in 1975 with second degree murder of Ms. Zaretsky’s mother. He was arrested on the tarmac of JFK whilst attempting to flee the U.S. to join his mistress.
Authorities discovered that he was in possession of jewelry and almost half a million dollars in securities belonging to his late wife. He was later found guilty of grand larceny and convicted of second degree murder for injecting his 48 year old wife with lethal doses of Demerol.
It is understood that UCO's investigation revealed his criminal past, but in accordance with policy, the association had the final decision regarding his request for occupancy.
David Israel, said he was “dismayed at the discovery”, and pleaded with associations to exercise serious consideration before approving any convicted criminal especially those on parole.

WE WON TODAY - SEE YOU IN COURT

Hi all,

After more than 4 hours of witnesses and testimony in the Issac Feder v Palm Beach County Code Enforcement case, Special Magistrate Carolyn Ansay decided that Mr. Feder was indeed using his Condominium unit in Golf's Edge for other than residential use. As a result, Mr. Feder was given 30 days to "come into compliance", or sustain a fine of $100.00 per day!

The evidence of violation was rather overwhelming as this long drama played out before over 400 Century Village residents, in attendance at the Vista Center main hearing room, and overflow chambers with video feeds.

The attorney for Mr. Feder, Esther Zaretsky Esq. made a powerful closing argument which was totally ignored by the finder of fact on the bench.

The key subtext to the "other than residential use" finding; is that the use in question is for prayer meetings.

Ms, Zaretsky eloquently invoked the Religious Land Use and  Institutionalized Persons Act RLUIPA, which states in part:

SECTION 1. SHORT TITLE.

This Act may be cited as the `Religious Land Use and Institutionalized Persons Act of 2000.


SEC. 2. PROTECTION OF LAND USE AS RELIGIOUS EXERCISE.


(a) SUBSTANTIAL BURDENS-


(1) GENERAL RULE- No government shall impose or implement a land use regulation in a manner that imposes a substantial burden on the religious exercise of a person, including a religious assembly or institution, unless the government demonstrates that imposition of the burden on that person, assembly, or institution--
(A) is in furtherance of a compelling governmental interest; and


(B) is the least restrictive means of furthering that compelling governmental interest.

Ms. Zaretsky passionately proclaimed "What compelling Government interest is impacted by dropping cigarettes butts on the ground" said act described by a witness as being ascribed to the prayer meeting congregants.

So, as the title of this Post suggests, we did indeed win today; but this case may be appealed, and I fear that todays decision will be reversed.

So, how should one proceed in such cases of "Other than Residential Use"? Look to Article XIII ( Use and Occupancy), or in the case of Golf's Edge, Article X, of your Declaration of Condominium; in other words, Enforce your Documents, and take violaters to Arbitration or Court.

The use of the condominium property shall be in accordance with the following provisions as long as the condominium exists and the apartment building or buildings in useful condition exist upon the land.

A. Apartments. Each of the units shall be occupied only by a family, it’s servants and guests as a residence and for no other purpose. Except as reserved to the developer, no dwelling unit may be divided or sub-divided into a smaller unit nor any portion sold or otherwise transferred Without first amending this Declaration to show the changes in the units being effected..........

REAL ESTATE FEES IN CV

If a unit owner sells their 1 bd/1ba condo for $20,000 the normal agent's fee of 6% would be $1,200.00
but the way it was told to me is that a R.E. Agent in CV has a ruling that the least dollar amount they will
accept is $2,000.00. Is there any truth to this.

Stepping on dog droppings is one of the more irritating aspects of life. In Israel, a suburb of Tel Aviv is testing a new way to determine who isn't scooping the poop. The local vet is collecting samples of doggie DNA, using a mouth swab from the pets. If droppings end up on someone's shoe, the city can check it against its database and fine the owner. Owners contribute the DNA sample voluntarily, but the city is considering making it the law.

The letter shown above has been sent to every unit owner in the Southampton Planned Unit Development (PUD). It is our understanding in UCO that the Developer is moving plans through all required departments in the County in preparation for presentation to the Board of County Comissioners (BCC) in the summer.

When the project comes before the BCC, all unit owners within 500 feet of the proposed development will receive notification of the hearing and comments will be heard.

I believe the time has come to establish a "Criteria" once & for all

29th UCO installation Lunch

SEARCHABLE CONDOMINIUM DOCUMENTS PROJECT MOVES SLOWLY ALONG

Hi all,

If you have been watching, you know that all of Andover's Condominium Documents have been launched into the Cloud and now are accessible on the Sidebar of this BLOG.  This now contains Andover A - M inclusive, over 120 documents; both original declarations and filed amendments: soon work will begin on Bedford.

There is a long way to go to Windsor S, and we may thank Ken Davis for working this project, slowly but steadily, which we all know, like the legendary turtle; wins the race!

This project is collateral to the document scan and digitization project; both projects could use additional computer literate volunteers. If you fit the bill, and wish to engage in a project that will be of great benefit to all unit owners, please come to UCO and ask to see Dave Israel.

Part of the scan and digitization project includes digitization of all extant issues of the UCO Reporter dating back to 1982; this is  currently in train.

We are making UCO history accessible and amenable to serious research; documents of every stripe are now searchable; Minutes, Agendas, Core Documents, Contracts, Invoices, Legal Opinions, Memos, Correspondence...Etc...! jump on board the train, help make it happen!

Rodger led the discussion and it was really good. so many questions asked about foreclosure showed us that we need more information . maybe we can get becker,et.al. to give us a seminar just about that. there are so many associations hurting due to this.

we did serve coffee and cookies as promised and we will do it again at the next meeting which will be april 13 at 9:30 in the party room.

SCADA Data on CV Reclaimed Water flow


Thanks to Hassan Hadjimiri ( •Director of regulatory Compliance at Palm Beach County Water Utilities Department) , we have the SCADA system (Supervisory Control and Data Acquisition) readout on Reclaimed Water flow into the Century Village lakes, canals and lagoons.

Hassan has directed the local processing plant to provide Century Village 22 million gallons of Reclaimed Water per month, until furthur notice.

This equates to approximately 723,287.6 gallons per day. The cost of this commodity is approximately $28.83 per day.

“One man’s junk is another man’s treasure”: STORAGE ROOM CLEANOUT IDEA

The problem for our association for a long time was how to know what was junk in our storage rooms that nobody wanted and what people still wanted saved. Some associations have brought everything out to the walkway and asked residents to return to their cubicles what they want. Then they have discarded what remained. This can be a mammoth undertaking, though. Residents have to be on hand, items to be saved (maybe heavy things) are moved twice, and the stuff remaining on the walkway has to be disposed of right away.
We think we have hit on a better way.
We have given all residents a sheet of blank decals, and there are extras in the storage room. The residents have a month to see that a decal with their unit number on it is affixed to any storage room item they want saved. They are urged, if physically able, to themselves remove anything they don’t want. At the end of the month, the more able-bodied among us will discard items that do NOT have a decal—plus, of course, any “community property” items such as the ladders, tools and boards.
Thus, the number of items having to be moved will be minimized, and we will be able to discard the throw-out items (anything without a decal) piecemeal—a few today, a few more tomorrow, more next week, etc.

ELECTION FOR EXECUTIVE BOARD

In another Post, a BLOGGER asks the names of the incumbent Executive Board members and implies that they have made UCO better; and thus should all be returned to office.

As UCO President I Post to advise you that the basic premise of that Post is erroneous.

Some of the incumbents and candidates for the Executive Board provide no new ideas whatever, they simply disrupt meetings, and do not research the issues. They bring noise but no signal; they bring heat but no light!

I will remind you all that you do not have to vote for ten (10) candidates, vote only for those proven candidates who have given years of service and provided new ideas consistently.

CODE ENFORCEMENT HEARING REGARDING ISSAC FEDER CONTINUED

Hi all,
The large hearing room at the Vista Center, 2300 Jog Road, has a rated capacity of 323 persons. Todays hearing, number 37 on the Special Master Docket, drew in excess of that number from Century Village alone. The response of our residents was marvelous, and exceeded any seen by Code Enforcement at that facility. A petition was submitted containing at least 800 Century Village Resident signatures.

Frank Cerabino, reporter for the Palm Beach Post was in  attendance, along with a Palm Beach Post staff photographer.

The essence of  Code Enforcements case is that Issac Feder is using one of his CV apartments, for other than Residential Housing.

Mr. Feder was represented at the hearing by Ms. Esther Zaretsky Esq. Attorney Zaretsky moved for a Continuance on the basis of not having received certain documents that she requested from the County Attorney, in a timely manner. 

The motion for Continuance was granted by the Special Magistrate, causing a rescheduling of the hearing to March 23, 2011 at 10:00am.

I spoke with the Building Administrator about Webcasting the hearing, which would allow us to onward transmit the hearing on channel 63; another remote possibility is that Code Enforcement will consider holding the hearing in our Clubhouse.

More news as it becomes available.

Hearing over on Vista today

I went to the meeting today. I found the facility to be very poorly prepared for us even thou they had been warned. The microphones were set on whisper so even under the quietest conditions, I could only understand about 1/3 of what was said. I was very ashamed of the audience who did not seem capable of not talking. I felt like I was surrounded by 100 swarms of bees as people whispered to their friends. The doors were open to the lobby and the people out there were just carrying on conversations in regular voices in spite of being asked to please not talk. I sincerely hope that by the time we go back for the postponed meeting people will have learned that respect in a meeting entails no conversation and listening to what is being said.

Quiet Workers or Noisy Talky Talkers

Its almost election time.
UCO is more businesslike everyday, saving our money, finding efficiencies – they are too busy to go around campaign talking. But outside UCO, we have our fast talking politicians who contribute nothing but misinformation gossip (I am being kind there). They are only interested in the power that allows them to PLAY with YOUR money. They do not have the skills necessary to run UCO.
You do not have to vote for a full slate, only give your valuable votes to those who are worthy workers.
