Annual meeting
Our last annual meeting was February 17th 2017 and I would like to know what would be the latest date we can hold this year's annual meeting. Thank you.
Hi Helene, Here is a brief extract from the Condominium Act, FS-718: .................................................. "(d) Unit owner meetings.— 1. An annual meeting of the unit owners shall be held at the location provided in the association bylaws and, if the bylaws are silent as to the location, the meeting shall be held within 45 miles of the condominium property. However, such distance requirement does not apply to an association governing a timeshare condominium. .......................................... Of course, the key word is "Annual"! So, you are cutting things a bit close, as, if this meeting is to include your Elections, you have no time to meet Statutory requirements for Notice.
Have your Management company set this up for you, better late than never!
This the the answer I received when I asked, i asked again via e-mail, answer was the same:
Good Afternoon Mr. Rivera,
This is what the statute states about Annual Meetings:
718.112(2)(d)1 F.S. states: An annual meeting of the unit owners shall be held at the location provided in the association bylaws and, if the bylaws are silent as to the location, the meeting shall be held within 45 miles of the condominium property. However, such distance requirement does not apply to an association governing a timeshare condominium.
And
3. The bylaws must provide the method of calling meetings of unit owners, including annual meetings. Written notice must include an agenda, must be mailed, hand delivered, or electronically transmitted to each unit owner at least 14 days before the annual meeting, and must be posted in a conspicuous place on the condominium property at least 14 continuous days before the annual meeting.
The statute leaves it up to your document to dictate when the Annual Meeting is to occur, as to date, time and location. Normally the documents will include the language as to no longer than 13 month from the date of the last Annual Meeting if no specific date is stipulated in the documents.
When I say association documents I am referring to the Bylaws and Declaration.
