Banks & Mortgage Co's will be liable for Assoc. Fees
URGENT from CCFJ: Folks, no matter where you stand on association reform -- no matter if you want the boards to have more power or less; no matter if you are a board member or an owner; no matter if you want fair elections or not, you need to make sure that Senate Bill S 780, yesterday filed by Senator Evelyn Lynn, will pass through the legislature and will be signed into law by the Governor!
This bill, in short, demands that banks and mortgage companies are liable for association fees owed by units/homes from the day of the filing for foreclosure. The bill provides for retroactive application.

Each Association should organize a letter writing campaign by their unit owners, asking Sen. Archer to vote yes on Senate Bill S 780. In this economic climate, any assoc. could find financial adversity, almost overnight. The banks have screwed us enough , don't let them get away with not paying foreclosed unit dues.

The Scheduled foreclosure date 9/08/09has come and gone. Bank of America files Lis Pendens and is going for a slow foreclosure on its own. Who knows how long this will take. Attorney will send letter to bank to "S..t or get off the pot" (non-legaleze).
Owner has since passed and Ad Litem was necessary to represebt his interests at a cost of $800.00. Expenses are at almost $5,000 and rising (not including in excess of $6,000 delinquency in assessments).
Yes, we need this bill passed, but realize that the Bank lobbies are as powerful as the firearms, pharaceutical companies, tobacco, etc. Our monthly assessments must be dramatically increased in next year's budget. Construct your budget accordingly as this may happen to YOUR Association!
