IS IT LEGAL?

An elderly neighbor of mine was recently in a traffic accident at the corner of North Drive and Glencoe here in the Village. The vehicle he was driving and another vehicle collided, and he ended up being taken to the hospital by the Medics ambulance service. His vehicle, in the street (North Drive) and considered unsafe to operate, was ordered towed away by the police. My neighbor was in the hospital two days and is now slowly recovering at home with in-home nursing care.

My neighbor INSISTS that the police had no right to tow his car away because, being in the Village, it was on private property. I cannot imagine this is right, for how in the world (to think of only one justification) would we ever get our Village roads cleared of damaged vehicles if this were the case?

Can anyone tell me (chapter and verse, if possible) what the law is concerning this situation?

30 Days or 10 Days for Approval by Associations

This is a question relating to Louise Gersons' article in the latest issue of The Reporter. Who determines whether as Association has 10 days or 30 days to approve or dis-approve an applicant for a purchase or rental? Is it determined by the Associations By-Laws or by Chapter 718? And is it a fact that the applicant is automatically approved if the Association does not act on the Application within the time mentioned? Randall is probably the one to answer this on a legal basis. It seems as tho not too many are aware of this and it should be known by all Associations.

AT & T MARKETING IN CENTURY VILLAGE

Hi all,
We have received a number of calls in UCO about AT & T aggressive marketing of products in Century Village. Salespersons, often in pairs are knocking on doors around the dinner hour and making presentation to sell our unit owners Digital Telephone service, High speed INTERNET and Television products. Taken jointly, the AT & T system is branded U-Verse.

A bit of background is in order; some 10 years ago, UCO signed an agreement, allowing AT&T the right, at some time in the future to come into Century Village and market their products. This right extended for 15 years from the time of signing, and thus has 5 years to run. In return for this right, AT & T paid UCO a significant sum of money. While a non-disclosure clause forbids me from stating the amount; it is in the six figure range.

Any unit owner interested in a copy of the Agreement may, of course, come to UCO for a copy.

Of particular importance is the fact that while the Agreement gives AT & T access, the Agreement specifically forbids Door to Door solicitation; thus these aggressive tactics are forbidden.

UCO will identify senior management at AT & T and put them on formal notice of this violation of the Agreement, but in the meantime, Association Boards must be vigilant in protecting their buildings from these tactics.

All unit owners must be further aware, that signing up for U-Verse will NOT relieve them from paying the Bulk Comcast Cable monthly fee.

Please do not rush to sign any contract without taking time to research the consequences!!

As an executive board member, you not only must live here a minimum of nine months, but also volunteer to serve on two committees. See,

I answer my own question, yes there is electric provision on Duck Island, (temporarily turned off.)
Our invasive weeds are pretty, what if we let them replace our grass? Less grass cutting! Actually if they keep spreading we may have no choice. 10 years ago I never saw these flowers in Florida.

THE BRIDGE TO SOMEWHERE - OWNERSHIP RESOLVED

Hi all,
There has been some question as to the beautiful landscaping on the path to Hastings Clubhouse. Specifically, as to who owns the property that the bridge spans and that just North of the canal spanned by the bridge. Well, Elaine and I have resolved all such questions under the project name "Midnight Mapper"! The following scan in will provide graphic evidence of the dispositive result:

The picture at the top of the scan in shows a red box which includes the bridge over the canal. this 30 foot wide strip goes East to Haverhill Road and as you can see above belongs to Winky Utilities, nee Century Utilities, Inc. (Obviously belonging, by route circuitous to Mark Levy) This is a drainage right of way.
Note now in the text portion below the photo the following statement, I will translate the abbreviations:

"drainage right of way lying South of and adjacent to 12th. Street Extension"

Mystery solved, if 12th. Street had indeed been extended West of Haverhill, this is the strip of land it was planned for. Hence, this piece belongs to Palm Beach county. I suspect that neither Mr. Levy nor Palm Beach County will object to the beautification effort!

Its Puss Caterpillar Season



Known as Puss, asp, woolly slug, various names but the most poisonous in the USA ! do not touch, there are spines of venom under the fur. How cute and only 1” long. When touched, these poisonous spines break off in the skin and cause severe pain. Most often found on oaks and citrus. In Florida there are two generations a year, one in spring and the other in fall. Some people experience severe reactions to the poison released by the spines and require medical attention. Others experience only an itching or burning sensation.

On the other hand, the golden-silk spider is harmless (to you), including legs it is as big as the palm of your hand. They are gentle and tremendously beneficial because of all the insect pests that they eat.

WHY GEORGETOWN TEXAS?

Hi all,
From the inception of our BLOG, we have had consistent heavy visits from the city of Georgetown Texas. I have wondered why. Finally I did some research this evening and I have the answer. One of the oldest and most venerable Age Restricted communities is located in Georgetown Texas. it is Sun City the Del Webb community.

It would be nice perhaps to establish a "sister city" relationship with Sun City and exchange some of our experiences as Senior Citizen communities. So, we in West Palm Beach Century Village would enjoy hearing from Sun City residents.
