If an upstairs condo unit owner is gone for the summer and we notice that his main water valve is left in the open position can we as a board member allowed to turn the valve off for preventive measures. Thank you so much for your advice.

Questions from the Community - Directories

As promised at our last Board Certification Class, I would begin publishing some of the questions we did not have time to discuss during the presentation.

We wish to publish a directory of unit owners, including their phone numbers and e-mail addresses, do we have to obtain their permission?

Section 718.111(12), Florida Statutes, prohibits the Association from giving out unit owners’ phone numbers and e-mail addresses. However, an owner may consent in writing to the disclosure of protected information. Therefore, the Association should have its community association attorney draft a waiver for the types of information you wish to publish. The waiver must be signed by all unit owners whose personal identifying information (phone numbers, secondary addresses, email addresses, etc.) will appear in the directory.

Voting by proxy

-
I have a question that I hope will be answered before our next annual condo association meeting. One condo owner (1) received a proxy from another condo owner(2).

Now condo owner (1) cannot be present to the meeting. She gives the proxy she received from condo owner(2) to a relative who will be attending the meeting. Is the proxy from owner(2) valid since the person who received the proxy will not be attending the meeting??

This has become very confusing to us. Some believe the proxy that was given to that individual must be handled by the same individual...not a third party. What do you think??? A quick response would be appreciated...Thank you.

Closing your Apartment

Should I leave the AC on in my vacant unit when I'm out of State?

NAME AND TELEPHONE NUMBER FOR EMERGENCY

I agree with the post about giving a key to your condo unit to your Association but I feel that every unit owner should give a name and telephone number in case of an emergency. This is very important information for one never knows when things will go wrong.

Giving your key to association

Hello to all,
I have a question concerning giving out a copy of your key to the association. One condo owner in our association refuses to hand out her key because they does not want anybody entering while they are not there. We ask each condo owner to give us a key so that we can enter for emergencies...like fire or water or pest control. What are the rules in this case. The condo owner who lives beneath these condo owners are worried they will suffer the consequences of these owners refusal. I would appreciate advice on this matter and what the regulations state. Thank you....Helene

Community Association System is a Total Failure

An Opinion By Jan Bergemann:
This system pits neighbors against neighbors. It makes homeowners pay for services for the neighbors who stopped paying. It forces owners to pay for the maintenance of properties that are collateral of banks and/or mortgage companies, the same entities that caused the whole financial misery by their irresponsible lending practices. Is that a system we want to continue?

rentable

I know in my assn, you have to own for 1 yr before you could rent out the unit ---a friend of mine lives in an assn that amended bylaws to make it a 2 yr ownership before rentable ---
Is the basic 1 yr rule applicable thru out CV or does each assn make own rule i.e. could an assn amend bylaws to ready no restriction /no waiting period - rentable upon purchase/ thanks.

DOES ANYONE KNOW ABOUT THIS PLANNED DEMONSTRATION?

The following 8-1/2 x 11 notice was posted on the Canterbury K bulletin board. It was not dated or signed. It had not been posted on our (Sheffield N’s) bulletin board the last I checked. I have copied it below as accurately as possible, including some misspellings.
I get the general idea, but..... Not all the references to article numbers seem to be correct. Our docs, like those of many associations, have been amended to allow certain pets, and so far as I can see our docs exclude boats and trailers from the condo property, but not motorcycles and trucks. As for planting fruit trees, etc., I didn’t see anything in our docs about this, but I could have missed something. Finally, I am no horticulturist, but wouldn’t a law prohibiting plants that attract bees be outlawing a lot of plants?
Can anyone shed any light on what this is all about and whether it’s being undertaken by serious people with some legal backing? What was on the sign follows:
CENTURY-VILLAGE RESIDENTS
THERE WILL BE A DEMONSTRATION JUNE 7TH BEGINNING AT 9:00 AM AT THE WEST-GATE OKEECHOBEE BLVD.
TO PROTEST

AGAINST ASSOCIATIONS THAT ARE VIOLATING THE GOVERN LAW OF THE FLORIDA STATUTE.

3. PLANTING FRUIT TREES. NON-PERMISSIBLE, PLANTS, THAT ATTRACT (BEES). A VIOLATION OF THE DECLARATION OF BY-LAWS ARTICLE XVII DOCUMENT.

Know where your money goes

Here's a link to an interesting article from the Palm Beach Post relating to your Association's funds. All owners should take an active part in the handling of their Association's affairs.
