Just amazing, regarding the vote on "canceling the BLOG". If I had been present at the time that the vote taken and the outcome determined (I had just limped back in the auditorium as the outcome of the vote was announced), I would have raised a "point of order", questioning the announced results.
ReplyDeleteLet's look at the facts. 255 Delegates signed in. 112 affirmative votes were cast to cancel the BLOG and replace it with a new Century Village Website. Based on the number of Delegates who signed in, this motion required 128 affirmative votes to have been approved. Again, there were only 112 affirmative votes cast, and therefore the motion failed, yet it was determined by the presiding officer that it had passed! The motion failed because under corporate law, and under the UCO Bylaws, a majority of the members present "is the act of the Board of Directors"! In the past four years of this administration, I have clarified this fact more times than I wish to remember, yet, even at the last Delegate Meeting of this UCO Administration, the outcome of a simple motion was improperly determined!
This incident clearly demonstrates how those people who are vested with the responsibility to uphold the Bylaws of UCO, fail to do so in even the simplest of matters... determining the outcome of a vote. Isn't this why we established a "Rule of Order" to change the order of agenda items, taking up New Business prior to Committee Reports? This change was instituted so that those who signed in would be more likely to remain seated at least until New Business was completed. Without any evidence to the contrary, or a point of order made (that some members had left), all 255 Delegates are considered to have been present when the vote was taken.
Our new President will institute procedures so that the voting cards are collected in the event that a Delegate leaves prior to a vote being taken. This will allow the Assembly to know exactly how many Delegates are seated at the time the vote is taken and how many affirmative votes are required for a motion to pass.
Really folks, I'm overwhelmed by the complacency which pervades the Administration of this Village. There was not even one person who questioned whether the outcome of the vote was accurately determined, and this includes each and every one of the officers who were present as well. I have great faith that this new Administration will attend more carefully to the UCO Bylaws and to the applicable Florida Statutes and Federal Laws which govern our corporation.
Gratefully, I am now being permitted by our new President to take a much more active role in the workings of UCO, and promise to do everything in my power to further serve the new administration, the Condominium Associations, and the residents of the Village as a whole.
