FLORIDA CONDOMINIUM DEREGULATION BILL BEING PUSHED ALONG - CAN THE WILD, WILD WEST BE FAR BEHIND

SUMMARY ANALYSIS
The bill repeals the regulation of the following professions, businesses and occupations:
• Athlete Agents
• Auctioneers and Auctioneer Apprentices
• Barbers
• Sellers of Business Opportunities
• Charitable Organizations
• Community Association Managers and Firms
• Condominiums, Cooperatives, Timeshares, and Mobile Home Parks
• Cosmetology Specialists, including Hair Braiders, Hair Wrappers, Body Wrappers, Manicurists, Pedicurists, and Nail Extensions.
• Dance Studios
• Employee Leasing Companies
• Professional Geologists
• Health Studios
• Home Inspectors
• Homeowners Associations
• Interior Designers
• Intrastate Movers
• landscape Architects
• Mold Related Services
• Motor Vehicle Repair Shops
• Sellers of Travel
• Surveyors and Mappers
• Talent Agents
• Telemarketing
• Yacht and Ship Brokers
It also repeals regulations relating to:
• Transportation access to outdoor theaters
• Rooming houses
• Sales representative contracts involving commissions
• Television tube labeling
• Water vending machines
The bill also eliminates the Division of Condominiums, Timeshares, and Mobile Homes as well as five professional boards.
The bill has a negative fiscal impact on state trust funds, with a corresponding reduction in expenditures. The bill has a positive fiscal impact on the private sector. See fiscal comments.
The bill has an effective date of July 1, 2011, unless otherwise noted.

In reality this bill is an open invitation to every scam artist and fraudster from around the nation. It's an open invitation to rip off owners living in Florida's community associations. This bill removes as well the possibility of punishing the "bad guys." It will create lots of jobs for scam artists especially targeting our elderly, telling them: "Come to Florida. Let's get to work!"
I got as far as the SUMMARY analysis this morning before breakfast, and didn't complete it. I can't imagine what the DETAILED analysis is like. My dad (a staunch Republican) would probably have liked a lot of this: "get rid of Government controlling every aspect of your life, with the attendant taxes, lawyers, etc." I agree until I think about how innocent people could be victimized. Me, oh my, what a mess! If "love they neighbor" were what we all automatically did, we wouldn't need all these rules. (I guess we'd still need a few to cover harm that could be done through ignorance.)

This was written by Lawyers for Lawyers. Lawyers are having a slow period and after this passes ,litigation will go through the roof. Everyone will be suing for lack of performance or fraud and push liability Insurance even higher. Hey!! We elected a Governor who defrauded Medicare of Billions ,what more could we ask for.
ReplyDeleteI should have said Floridians elected a Governor whose Company defrauded Medicare of Billions while he was a director. He himself didn't defraud the Government. Must watch what and how we say things,now that we are about to enter the new era of unbridaled litigation in Fl..
