PETITION FOR REMOVAL OF UNITED CIVIC ORGANIZATION, INC. ("UCO") PRESIDENT, CENTURY VILLAGE , WEST PALM BEACH, FL.

WHEREAS: Pursuant to UCO By-Laws, As Amended (March 2, 2012), Article XI (E): David Israel, the current UCO President ("President") has acted recklessly in contravention of Fla. Stat.§§ 617.0834 and 718.111(d), and has committed acts or omissions in bad faith as President;
-
WHEREAS: The President has presented to UCO's members ("Members") intentionally inflated and unsubstantiated financial statements regarding its financial condition;
-
WHEREAS: The President has delivered to the Members false statements, both verbally and in writing, so as to deceive or give the wrong impression regarding issues of concern to the Members;
-
WHEREAS: The President has intentionally failed to follow UCO's By-laws, and in particular, Art. VIII(C), Article IX, with respect to the execution and performance of contracts for goods and services in excess of $1,000 without approval by the Finance Committee or Delegate Assembly, and overruled a Bid Committee's recommendation with respect to a contract between UCO and M & M Paving, Inc., and of contract rules.

WHEREAS: The President is not performing effectively, in that he has: (i) failed to act in the best interests of UCO's members and in violation of UCO Bylaws Article VII (A); (ii) has defamed both past and present UCO officers, executive board members, and delegates; and, (iii) bas failed to abide by the letter and spirit of UCO By-laws Article XI (Sunshine Laws); and

WHEREAS: The President has failed to seek professional legal advice, as would a reasonable and prudent officer, with respect to issues of major importance to the Members requiring interpretation and definition of written agreements, and instead has imposed his unilateral decision(s) regarding same by fiat.

WHEREAS: The President owns and controls the "CENTURY VILLAGE® in WEST PALM BEACH" blog which he presents as the official blog of C.V. of WPB, to abuse the Members by disseminating vicious attacks on individuals and groups who oppose his personal ideas as well as his false assumptions and facts. This blog was never authorized by the officers, executive committee and the delegates. This blog is not sanctioned by UCO's bylaws as is the UCO Reporter.

WHEREAS: The President permits a certain non-elected person free access to the inner offices of UCO as well as attendance at important private meetings while not having the appropriate officers present.

WHEREAS: The President permitted a member of the officer's committee on behalf UCO to contact a local government official to unduly influence the Building Departments decisions as to the Drainage and Paving project.
-
THEREFORE, We, the following group of not less than 35 UCO Delegates, respectfully request that the Officers Committee appoint a Board of Inquiry in compliance with UCO By-laws, Article XI (E) Removal of Officers, with respect to the removal of David Israel from the office of UCO President, and that such hearing be held expeditiously.

In the absence of such appointment of a Board of Inquiry, the undersigned demand that a vote be duly called at a special meeting of the Delegate Assembly, provided a quorum is present, with respect to the removal of the President.

YOU MUST BE A DELEGATE IN ORDER TO SIGN THIS PETITION

The above petition was delivered to UCO by three of the "Usual Suspects".
Those would be the ones who disrupt our Delegate Assembly almost monthly.

When will the silent majority rise to put these people down.

Did they really think we would not notice the duplicate signatures, the lack of dates and the illegible scrawls???

  2. No good deed goes unpunished, in Dave's case several thousand good deeds. How many $$ and how much time wasted have we spent to give these people access, legal opinions, etc.

  3. This petition is hogwash, David is one of the best Presidents that UCO has ever had. The accusations are empty, inaccurate, and totally without merit. Would one of these people who only have negative things to say, have introduced our US President with such class? I was so proud of him that day. David has been a manager for many years, he knows how to deal with people. If we put these people who have never offered a positive suggestion, into office we will hang our heads in embarrasement. He is carrying out his duties with competence and professionalism. Let's stand by him, praise him and be thankful that we have such a good President

  5. There are more of us "for" Dave than against him. If the paper the recalls are printed on are not too scratchy, they know what they can do with them. Carry on, Dave. You have brought renewed vitality to the Village. Here's to an unlimited term.

  6. When reading the signatures, it makes me wonder how many actually knew what they were signing. Did they sign because the were afraid of the person that was asking for the signature? Or did they sign because they believed the lies that someone told them? Did they really check out the statements that were being made in the petition to see if they found them true for themselves?

    I think it is time for all of those who think Dave is doing a good job to stand up with him and show these trouble makers the door.

  8. Why don't these disgruntled people put their efforts toward the welfare of our village? We could not afford to pay for the time Dave gives to UCO. I'm certain common sense will prevail.

  9. I totally agree with all the above comments. I believe Dave does an outstanding job. In the 9 years I have lived at CV I have never seen a President work so hard and do so much for the benefit of the unit owners. I think at the next Delegate Assembly we should all rise in support of Dave.

  11. As the expression goes "they must be kidding".... but they're not. Can't believe this is happening. We never had it as good here in the Village as it is now. Dave Israel has done a marvelous, wonderful yoeman's job of taking care of UCO. It's a shame that such unworthy discension will be available to viewers where ever they live. My, oh my, how sad it is that we have to endure these goings on.

    Of the 15 years I have lived here in CV, you have been the most knowledgeable and efficient president we have ever had. Hang in there. The majority of us are behind you. The malcontents seem to be crawling out of the woodwork -on all levels of organization - such an abundance of contentious squawkers - begining with the lowest level - condo assn bds and moving on up ---truly Dave has had to drag (them) kicking and screaming into change and advancement - God bless all of us who volunteer on any level

Whatever the issue and whatever the feelings involved, to compare this to the Inquisition, even, if not even more so, in a humorous manner, referring to a time when Jews were tortured and burned at the stake, dispossessed and expelled from a country(ies) - this is quite offensive. Please remove it.

    It's a joke Jerry, just like this absurd petition to which you appear to be signatory.

    If you want this Post to go away, tell your friends to make the petition go away.

    It is disruptive, pointless, and adds nothing to advancing Village goals!

    As the first fallout of this nonsense, we have lost to resignation one of our most productive citizens; that being Randall Borchardt our Advisory Chair.

    Exactly how much damage are you and your friends willing to inflict in pursuit of power and personal aggrandizement??

    So watch the Mel Brooks clip again, because that is exactly what this petition is about, an inquisition and witch hunt.

  17. How many of these benighted people got their 'information' from someone else on the list, such foolishness.
    How many think Kevin Swill offered to buy something, read the 'offer' - he didn't.
    How many think UCO didn't help by encouraging an extension, actually UCO gave them another chance instead of being crushed by Aaronson.

  18. if all those that signed this are delegates, did they go to the associations that they represent and take a poll of unit owners to see if all are in accord? i know the two from my association that signed did not.

    I do not consider myself the first fallout of this ill-conceived battle, more a casualty of war in what has been allowed to escalate into a conflict of power. Whoever ultimately claims victory, there will be no winners, only losers – the Associations and residents of the village.

    The UCO Bylaws are there to be followed, not used to suit anyone's personal agenda. It was becoming more and more apparent, over the past year or so, that some of the changes to the Bylaws were wrongly motivated, and the one's which we've had for many, many years, are now being abused. The recall of a President is an extremely serious matter, and should only be used as a last resort, not the first, or just an
    easy option.

    Having witnessed a power driven seesaw over many months, I couldnt, and more importantly wouldnt, continue to involve myself in this path of destruction any longer. Enough is enough. My time, I feel is better spent helping the people those who need my help and advice - the Associations and residents... something both sides seem to have lost sight off over the past few months.

  20. I have lived here 6 years coming March. I have nothing to say but positive things about Dave Israel since he took office. Remember, nobody is perfect and we are all entitled to mistakes. Keep up the good work David, there are more residents on your side than against you.
