It seems no one cares including our officers that an officer is in violation, maybe? Could we get some answers, or does no one care if the by-laws are followed. Our by-laws should be followed by all, especially our officers. Maybe we should just get rid of the by-laws or are they just applicable to some???????

DOES NO ONE CARE ABOUT OUR BY-LAWS OR VIOLATION OF THEM???
ARTICLE VI
OFFICERS
All Officers of UCO must be members of UCO, and be domiciled and reside in Century Village, West Palm Beach, Florida, for a period of not less than nine (9) months of each year in which they serve.

Hi Barbara,
ReplyDeleteI care, and the UCO Attorney cares, and opines: "she must resign"
Also note the BLOG that supports Ms. Sutofsky states:
"WE are against the thoughtless Residency rule"

I too am most firmly in favor of
WiFi...however, we have a larger
problem here..A Budget,proposed by
one, who is in violation of one of
the Bylaws,which the majority of
this Community is aware of..namely
where one "Domiciles"..Should this
become a non issue, then by all means, change the by law, but until
that time, they must be adhered to.

Betty, you are so right, moreover, her vote to take WIFI off the budget should not count at all.
I hear she is looking for a rental in order to attempt compliance but just renting a place and living in another still does not make it your place of domicile. It should raise some MAJOR flags when someone is handling so much money, and is willing to pay for the privilege.

Regarding rental, rumors,no doubt,
however,County documents & common
knowledge reflect co ownership in
Oxford Colony,in addition to Cyprus Lks. HOWEVER,the issue here
is violation of UCO's Bylaws..
No Letter of Resignation or Appeal
has been submitted to continue in
Office, until expiration, which
indicates "Disrespect" to each &
every Delegate, who in turn represent YOU, the Unit Owner!

Very well put BettieL, who would have thought we could have an Officer that disregards the Bylaws and the spirit of the Bylaws, and all respectful behaviour.
Barbara, if you have known that Dorothy does not live in the Village why have you not asked for a recall of her. Yes it is outrageous.
ReplyDeleteWhy does it have to come to that?
ReplyDeleteThere is a Delegate Assembly on Friday. The Treasurer can put the matter to rest, once and for all, by rising and offering an honest, forthright explanation of her residency situation, hopefully without the use of legal jargon like "domicile" and "homestead".
The Treasurer obviously believes that she meets the requirements for continued service. If she didn't, Honor would require her to resign.
Rather than the Delegates having to endure another tedious recall dog-and-pony show, why not just hash it out now, or at least let the Delegates hear what the Treasurer has to say.
We haven't even cleared up the last ridiculous lawsuit from the last ridiculous recall. Why don't we try to resolve this matter among ourselves for once?
Don, that has been obvious to everyone but the Treasurer for the past 9 months. Although the bylaw is clear there seems to be a problem enforcing it. No doubt there are legal costs to untangle the impasse.
ReplyDeleteElaine, I watch the Delegate Assembly every month. Noone has ever directly asked the Treasurer to explain her residency situation. Why should she respond to a question that nobody ever asks?
ReplyDeleteIt's no big deal- it's actually a pretty common question in Century Village, part of the small talk that people make here. People ask me where I live all the time- at the pool, the Coffee Shop, the gym.
"Where do you live?"
Don, Officer issues are usually resolved in more private Staff and Officer meetings. We can only guess at their results. Dorothy did have ample opportunity to explain thru several Advisory Cmte meetings that worked on the residency enforcement bylaw. I observed one of these. Malcontents were delighted to foment a mess.
ReplyDeleteHi Don4060,
ReplyDeleteOctober 3, 2013 at 8:47 PM,
OK! here is your WJ Clinton moment:
Barbara Cornish asked the very question you suggest, at Delegate Assembly; the response from our Treasurer:
"Define Live"!!!
As President Bill said; "It all depends on what the meaning of the word "is" "is".....
Dave Israel
This is pretty much the answer that I expected.
ReplyDeleteThank You Barbara, for finally asking the question. Somebody had to.
When Barbara came out and asked Dorothy, her reply was "define Live".
ReplyDeleteDorothy, how is this, where do you lay down and go to sleep EVERY night? Where do you make you dinners at every night? Where do you bathe every night? or how about, where do you sit on the toilet the most? or how about Your buddy's Ed Grossman's definition loosely put, where do you...? Your little game of asking for a definition only PROVES how deceitful you really are. Yes Dorothy, you have alot of friends here. You've lived here for quite a while, but we're not good enough for you to live among anymore, you've gone "high society" and move to Cypress Greens... Well what about the CURRENT by-law on the books. It still requires you to be domiciled on Century Village for nine months of the year. Domiciled: (according to Webster's)
a dwelling place : place of residence : HOME
a person's fixed, permanent, and principal home for legal purposes
According to the County Assessors, your principle place is in Cypress Lakes.
YOU DON"T LIVE HERE. GO HOME. Run for office in Cypress Lakes. At least it would be legal there.
