Newly approved amendments

We have a question and would appreciate an answer as soon as possible. After amendments have been approved and legally processed should a copy of the new amendments be sent out to all the association condo owners. We have conflicting ideas among the board officers on how to proceed with this matter. Thank you

I believe this is the right answer: After the amendments (I assume to your bylaws or Declaration of Condominium) have been entered into the county records, you should receive a copy (or copies) stamped, showing they have been RECORDED. The secretary of your association, or whatever officer keeps the records, should then make copies of this stamped copy for all owners, plus, I would suggest, a few extras. Each owner should be told to add the amendment page(s) to his copy of the association's condo documents (Declaration of Condominium, Bylaws, and Rules and Regulations). Each owner is responsible for having up-to-date docs and passing them on to the new owner when the property is sold.

    The reason for a few extras is this. We keep an association "original"—the stamped copy given us by the county and never let this out (it might get lost). We also keep a "master copy" of ALL the pages in our condo documents, including amendments, in case an owner has misplaced his docs. We then have copies made from the MASTER set. We have somebody responsible get these at a copy shop, and we charge the owner a nominal fee for them.

    One further suggestion. If your docs are printed only on one side, number the pages on the back side from 1 to (whatever) so if they get out of order you can easily reassemble them. The numbers on the front side can be quite confusing.

  3. Unfortunately not everyone gets a copy of the documents when they buy. The previous owner may have passed away and the heirs pack them away or throw them out. In cases like this, it would be prudent for the association to have spares and provide them to new owners. Many owners both new and old don't even give the documents a second glance and this is where many of the troubles begin.
