Dish

Has anyone worked thru the issue of having a TV dish on the grass outside their building. Info appreciated TIA.

In response to Grace's Comment; the Federal Communications Act must be read very carefully, along with Randalls perceptive comments following the main Post. The Condominium Association is in no way precluded from enforcing restrictions on placement of satellite antennae on the Common Element which are in violation of FS-718 or for that matter of the Association Documents. Following are but two Arbitration Decisions which are on "on point" in this matter. There are many other similar Arbitration decisions:

  1. I live in the association in question with the president allowing the dish and not consulting the Board. The owner who had the dish on the side of the building threatened to sue us saying his lawyer advised it saying he would win. Dan Gladstone kept pressing me to proceed but frankly we could not afford the lawsuit and then I found that the Federal Government allows dishes over riding the Board. The owner in question passed away and his daughter took the dish down. We still have the dish that is on the grounds behind another owner's condo and are not going to pursue that either.

  2. We don't allow dishes on the front of the building (roof or catwalk). The bylaws allow the Board to make that decision. Owners can put dishes on their porches or on the back roof rail behind the building, with Board permission.

    A building cannot (should not)allow one person (a President not withstanding) to make decisions without a Board vote. Someone can easily challenge or just ignore a such a single person decision.
