I live in Salisbury B. Of the nine associations in the Salisbury group, only 4 are registered. Of the 5 that are not registered, I wonder if they also tend to miss the monthly delegate meetings? Did they vote in the last election? Are they having difficulties trying to manage there associations?
ReplyDeleteI still believe that it is very important that the list of associations not attending the monthly Delegate meeting be posted in the UCO Reporter. This is one of the only ways individual unit owners can tell if they are being represented.
Quadrant Vice Presidents need to be taking a more active role in assisting their assigned associations.
Thank you Dave. I just checked and found out that we are O.K. in Hastings B, but need to renew by 10-13-2010. Will be looking into it so that we will be in within the law.

Our association is good until June. How does one renew? Do we get a bill?
ReplyDeleteDenny makes a good point. There are some buildings in Sheffield that seem to have no active boards of directors, and never attend a UCO Delegate meeting. Our previous UCO section VP was never helpful or ever around to find out what is going on with these associations.

ReplyDeleteThere are exactly 100 Associations which have been delisted. Seacrest Services, Inc. has a list of all 100 Associations and will be sending the Registration form to each of them regardless of whether or not they are a client. It is good public relations on their part, plus they "owe me a few favors". This was OK'ed by Dianna Evans and Andy Rosen is working on it. There are exactly two hundred Associations which will be delisted during the course of 2010. I am preparing all 200 "Renewal Forms" including the listed condominium and their proper corporation name (which is often different). Mary, from UCO, is preparing the labels for those two hundred Associations. David has authorized this action since he wishes for each independent entity (Association) to adhere to the requirements of Florida Statute. For those who wish to know "where it is written?", they may go to 760.29(4)(e)which clearly shows the requirement for each "55 years and older" condominium be listed. Most of the renewals, except for four(4), will be required after June 10th, 2010. Unfortunately, Association renewal forms sent by the FCHR are to the address last listed. So if the President of an Association in 2008 is not your present president, he will not receive the renewal form if your expiration is during 2010.
All Associations which are to expire in April have been personally contacted by myself. UCO cares about you.
Great that we are going to be on the right side of 55+ benefits. Must have been extra effort to pull together, UCO and Seacrest, not as simple as it sounds.

I just spoke with Andy Rosen (from Seacrest) and he assured me that ALL 101 ( I found one Association that expired in February and had it added to list) delisted Associations will have the proper corporation listed on the "Community" line of the "Registration Form" and sent out by the end of next week at the latest. Once an Association is delisted, it must use a "Registration Form" and not a "Renewal Form". A second, and very important act which must be taken, is for each "55 Years of Age and Older" Association to establish (unless you have already done so) a list of the ages of each and every person who occupies the unit. This must be "refreshed" every two years. You may photocopy the identification from each application, or if the application has "disappeared" because the owner or tenant was approved many years ago, make a copy of the license or other acceptable government issued ID for that occupant. This procedure is called "Verification of Occupancy" and is Federal Law (Housing for Older Person's Act) and Florida Statute as well. This action is essential in the event that such information is requested by the FCHR or Palm Beach County Office of Equal Opportunity. It will especially be requested when a housing discrimination suit is filed against your Association. Be prepared. The Verification of Occupancy requirements and procedures will be included in the “package” sent to every Association. About four years ago, I engaged in the same proactive procedure and attained over 99% compliance for Associations registered and listed. Toward the end of the year, I will again review the Registry, and personally contact those Association Presidents who failed to comply with the law. I agree, but the Association must request our assistance or we may cross the line of interfering with the affairs of the Association (which is an independent entity). I am always available to assist. I can state over and over again that every Association should purchase "The Condominium Concept" by Peter M. Dunbar (11th Edition ONLY), but unless the Board and Officers are willing to learn more about how condominiums are supposed to be run, then they will consistently act in opposition to established legal practices. Apathy and indifference are powerful foes!

I totally agree Denny, but I believe that we would get a clearer picture of absenteeism by Associations if the Reporter would create an annual percentage for each Association that is less than 50% attendance. It would be a sign of "troubled Associations" and these may in fact require proactive assistance by the Quadrant Vice Presidents. Associations exhibiting a low percentages of attendance at the D.A. may be in need such of assistance.
