Pet Issue

Let me start off by stating that our condo association documents do not allow residents to have or keep pets in their apartment. That said, last May one of the owners came to the board asking permission to watch her daughter's dog for 3 months while she was out of the country. The board granted her permission with the proviso that the dog be walked outsde CV and must leave at the end of the third month. About three weeks ago this same owner came to the board and asked for an additional 7 weeks as her good friend,who lives in the same building, is undergoing chemo and has become attached to the dog and wants it as a companion animal. The Board met an unanimoisly voted that the dog must go. The owner was told verbally of the Board's decision and a certified letter was sent to the owner advising her of the board's decision but that letter was never signed for or acknowledged. We now plan to take legal action but we like some feedback from other bloggers as to their thoughts and suggestions.

  2. Hi all,
    Clearly the first critical error was allowing the three months! If you have a Bylaw forbidding pets, you must stick to it, except for exceptions provided in Law; EG. Certified Service Animals.

    There is much case law on "Prescription Pets" I see no reference in your question to this issue.

    When you open the door for one, for no valid reason, you have stepped on a slippery slope indeed.

  3. The gentleman that now wants to keep the dog, supposedly has a doctor's note on the need for a companion pet. I have not seen it nor has it been offered to the board to read. I agree the error was made back in May. Now the question is can it be corrected.

    Slowly the facts creep out, ok! What kind of Doctor? Yes, it will matter, if a regular GP, not much weight, if from a Psychiatrist, with the right buzzwords, your building may be stuck with a new 4 legged resident!

  6. The doctor is either a GP or oncologist. Definitely not a psychiatrist. Try to help someone out and then get lied to and called callous and insensitive.

  7. Violation of the bylaws or guidelines by the board is the real system problem and should be corrected. Enjoy the dog.
