Are unit members allowed during reorganization of board members???

I have a question to ask concerning who in a condo association is allowed in reorganization meetings for our board members. We just had a general election this morning at our condo association and after the election, the newly elected board decided to meet privately in an unit to establish who would be officers. Were we allowed as a unit owner to be present during the selection of officers? Some say yes but on the condition that we do not voice our opinion. I would like to be cleared on this subject. Much appreciation for your response.

  1. Hi Helene,
This is a very scary question.
So, as I understand it, you had your elections for your Board of Directors, and then your new Board decided to have a secret meeting to elect Officers for the new Board of Directors!!

Stated simply, No Good. The new Board could have held an immediate election by secret ballot in the presence of the Unit Owners. It is simple as that, and of course the Unit Owners may attend.

There are very few situations where secret Board meetings are acceptable, usually revolving around certain legal activities.

Finally, your Board needs to consult FS-718, or an Attorney to get direction as to how to conduct these meetings. UCO sponsors classes by Mark Friedman Esq., for Board members, which are very informative.
