Condo Board members are voted in by deeded owners, but do not have to be owners themselves. We have renter Board members and benefit from their efforts - but they do not have votes. No requirement such as you refer to in our docs, others might be different.

ReplyDeleteThis is a question which you should bring to your Association Attorney.
My opinion is that FS-718 uses the phrase "any eligible person".
I do not believe eligible = must be a board member.
There are a few issues that render a person in-eligible, such as a felon whose rights have not been restored, or a person who is in arrears to the Association.
As you can see, there are complications, and you really should consult your Attorney.

'Eligible' = helpful, available, honest, business savvy, speaks American, renter in good standing. I am not a lawyer.
ReplyDeleteAnyone can run for the board...and also vote...It is advisable not to have a husband and wife. but that is up to the individual boards. check your bylaws.
