CONDO BOARD QUESTION

Is there any mandate for a Condo Board Member to be a "deeded" owner of a unit within that condo? If so, where is that requirement found?

  1. Condo Board members are voted in by deeded owners, but do not have to be owners themselves. We have renter Board members and benefit from their efforts - but they do not have votes. No requirement such as you refer to in our docs, others might be different.

    This is a question which you should bring to your Association Attorney.

    My opinion is that FS-718 uses the phrase "any eligible person".

    I do not believe eligible = must be a board member.

    There are a few issues that render a person in-eligible, such as a felon whose rights have not been restored, or a person who is in arrears to the Association.

    As you can see, there are complications, and you really should consult your Attorney.

  3. 'Eligible' = helpful, available, honest, business savvy, speaks American, renter in good standing. I am not a lawyer.

  4. Anyone can run for the board...and also vote...It is advisable not to have a husband and wife. but that is up to the individual boards. check your bylaws.
